Council tax non-payers names are finally revealed

The names of the four Cornwall councillors taken to court for failing to pay their council tax have finally been revealed.

Five months after the Packet first revealed the number of members missing payments, a succession of Freedom of Information requests and a trawl through magistrates courts records have brought the names into the public domain.

They are; *Councillor Chris Pascoe (Lib Dem, Threemilestone and Gloweth), taken to court in July 2011 for arrears of £1,805.31 *Councillor Sasha Gillard-Loft (Lib Dem, Launceston South), taken to court in March 2010 for arrears of £210 *Councillor Jan Powell (Lib Dem, Liskeard North), taken to court in August 2010 for arrears of £833.85.

*Councillor Alex Folkes (Lib Dem, Launceston Central), taken to court three times, the final time in July 2011 for arrears of £811.07.

Despite each being approached by the Packet in October and directly asked if they had ever faced legal action against them for council tax arrears, all four chose to offer no reply at the time.

Councillor Pascoe explained that his father's death in 2010 had led to his problems with the tax payments.

He said: "My father had owned the house, and had been responsible for the bills at the property.

"During the year afterwards, due to the emotional turmoil and there was so much legal stuff going on at the time, that I overlooked it and have since settled it in full."

Councillor Folkes' problems with his payments were first exposed two weeks ago, when he admitted having failed to pay his tax twice.

However, BBC Cornwall's Graham Smith, who has worked alongside the Packet on the investigation, unearthed a new liability order from last year, showing Mr Folkes, deputy leader of the Liberal Democrat group on the council, had failed to pay for three consecutive years.

He has claimed he forgot about the third incident, issuing a statement to Mr Smith saying: "I apologise for inadvertently misleading you and your listeners due to not having a clear recollection of the events of three years ago.

"I remain deeply sorry that I got myself into such a position but have been very grateful for the kind words of support given to me by colleagues from all parties and the people I represent."

Councillor Gillard-Loft said: "I got behind with one or two months because the person who owns the house, and who pays half the council tax, had an accident and was off-work.

"Because he's self-employed he didn't get paid and so we couldn't afford to pay it. I'm a full-time councillor and have no other income apart from my councillors' allowance. It was a genuine case of financial hardship."

Councillor Jan Powell was a member of the Conservative group at the time the liability order was issued.

Her husband, former mayor of Launceston Tony Powell, said: ""We had no knowledge of any Liability Order until December 27, 2011, when contacted by the Councils' solicitor.

"Through a combination of an inadvertantly cancelled Direct Debit, a botched standing order and my ill-health we missed payments in April and June but the arrears were cleared in May and July by double payments.

"By July 23 there were no arrears and a new arrangement in place.

"At that time we understood that no summons would be issued given our excellent payment record and the circumstances of the missed payments.

"At no time was there any intention to avoid payment or any any question of our ability to pay.

"We have details of our dealing with the Council and have made representations to them over what subsequently took place.

"We have discussed the issue with them and are awaiting a response"

Councillor Jeremy Rowe, leader of the Liberal Democrat group on the council, said he was disappointed by the fact four of his members had been revealed as recipients of liability orders.

He said: "Obviously I'm not pleased about this news and I'm now asking all the members of my group, wherever possible, to pay their council tax by direct debit.

"There may be occasional cases of real hardship and in those circumstances I want people to tell me as soon as possible, and to talk to the council about it."

Speaking about his deputy's non-payments, Mr Rowe added; "Alex has said sorry about this - I accept that he did not intentionally mislead anyone - and as far as I'm concerned that's an end to the matter.

"I don't see this as a resignation issue. Alex is a great guy, a really hard-working councillor who does a great job of opposing the Tories in the council chamber - and that's why I think they're gunning for him on this issue."

The one councillor who voluntarily came forward and admitted he had received a liability order for non-payment of tax did not need to identify himself, court records have shown.

Councillor Andrew Wallis, who contacted the Packet in August to admit he had run into arrears in 2009, had the order issued when he was a member of Kerrier District Council, and not part of the yet-to-be-formed Cornwall Council.

Thank you to the Packet for printing this article. (I bought my Packet at 0600 this morning) I have maintained throughout the duration of this issue, I do not have a problem with the council tax payment defaulting issue, I have a problem with the honesty issue. Andrew Wallis was honest from the start, and has my complete respect. However these remaining four councillors were not honest when asked by the Packet months ago. During this time they have put other councillors under unnecessary suspicion. This issue is of obvious interest to a percentage of the public as has been proved. I am glad that these councillors have been named as it would have remained unfair at election time on Andrew Wallis, had he been the only one that the public were aware of as a defaulter on a council tax payment. I personally would not vote for any councillor that in my opinion I deem to be dishonest. I believe honesty combined with being effectual in ones work, is far more important than defaulting on council tax payments.

I find it interesting that on his blog he mentions "That some councillors are now demanding to know who StAustellAdam and Zella are"- Well I would like to know which councillors would like to know who I am.? and why? Unlike some people, I do not hide behind anonymity, nor do I use a pseudonym. For the record, I am completely honest, I am a member of the public and have been lucky enough to never have needed to default on my council tax payments. Next question?

Well done Packet for finally unearthing these people who through a combination of lying and refusal to answer simple question have finally been exposed.

And what a surprise, they are all Lib Dems. Do what we say, not what we do.

If you look at the goings on at Helston Town Council, which is run by a Lib Dem Mayor and Lib Dem Mayoress, yet again it comes down to money and not answering simple questions.

And again look at the Lib Dem MP for Helston. Had to repay £10000 in expense, due no doubt to someone elses error.

I think I see a pattern here.

Sorry, The end of my first post should have read - I believe that honesty combined with being effectual in ones work is far more important than the issue of them having defaulted on council tax payments.

I have read the Skipper's article, that accusations have been made, that the story is little more than a witch-hunt aimed at discrediting the Liberal Democrats, it gave me a good laugh. Nice Try. Is that the best they could come up with.

Unfortunately I have been away for a couple of days so have missed all the excitement and shenanigans since this expose hit the headlines.

I agree with Zella on these points: it is not about the fact that some Councillors missed payments or even that they were subject to Court action from the Council of which they are members. It is the deception and deceit in trying to hide from the facts that is hypocritical.

Of course Councillors Kerridge and Wallis deserve heaps of praise - they made mistakes, as do we all, and were open enough to admit to these mistakes. That makes for a good Councillor in my book. I hope the electorate of Cornwall remember these differing approaches to representation the next time elections come around.

As for certain Councillors "demanding" to know who I am, I only have one thing to say: check the webcast on the Cornwall Council website from 06 September 2011. If you fast forward to about 17 minutes you will see me there, in the chamber, asking questions of the Council leader about whether the Council would reveal the names of the defaulting Councillors.

I am not hiding behind anonymity or even behind the Data Protection Act - I was there amongst you all. Oooops! Not quite all of you. Thirty seconds before I arose to ask my questions a certain Councillor Folkes got up and left the chamber, returning shortly after my questions had concluded.

Now ... isn't that a coincidence?

I have it on good authority that they are "demanding" to know who we are because our words and actions are politically motivated.

Hmmm! Politically motivated fair comment against elected Councillors ... that is a scandalous state of affairs.

I find it exquisitely ironic that they expect their own demands (for information about our identities) to be complied with ... yet they also feel that demands from the Council (for Council Tax) and demands from the public (for information relating to elected representatives) should be vigorously contested.

I would like those Councillors "demanding" to know who I am to make themselves known to me ... indeed I also "demand" to know who they are ... who do they think they are making demands such as this?

Bloody impertinent cheek if you ask me. Scallywags the lot of them.

Having listened to all the reasons/excuses, from these four councillors, if they really believe they are true and acceptable to the public, then why on earth did they not answer the 'Packets' questions months ago. They could have been honest months ago and just said, this is the reason bla bla bla and I am sorry it was an error on my part. As far as I am concerned, that would have been acceptable. However now, I am not at all impressed with their lack of honesty. As for demanding to know who I am, I hardly think I and StAustellAdam are the only two members of the public that wanted their identities exposed. I am in no doubt that they now know perfectly well who we are, so what has that acheived.
