Potter twice legal drink drive limit in Helston

A self-employed potter suspected of being a drink driver insisted he had not had anything to drink, even though he tested at more than twice the legal limit.

Arrested by the police, he later admitted he had been drinking alcohol.

At Truro Magistrates' Court Russell Gibbs, aged 45, of St Martin, pleaded guilty to drink driving at Helston on December 7.

Gail Hawkley, for the Crown Prosecution Service, said police officers stopped him because he was seen at 9.20pm not wearing a seat belt while driving.

He smelt of alcohol and failed their roadside test, later registering 91mcg of alcohol in breath.

Paul Simons, his solicitor, said he had been drinking after a fall-out with his girlfriend.

He was fined £160 and £105 costs and surcharge, and banned from driving for 24 months.
